Praktik Jual Beli Lotre Mainan Anak Ditinjau dari Hukum Islam dan Undang-Undang Nomor 7 Tahun 1974 tentang Penertiban Perjudian (Studi Kasus di Desa Pelemkerep Kecamatan Mayong Kabupaten Jepara)

Abstract

Buying and selling activities are common in society. The sale and purchase of children's toy lotteries is a practice that resembles gambling because of the practice of raffle. The community considers buying and selling children's toy lotteries like buying and selling in general and see the lottery being sold as just a toy without any intention of playing gambling. Therefore the research is interested in examining in more depth the practice of buying and selling children's toy lotteries and to find out how the law of buying and selling children's toy lotteries is according to a review of Islamic law and Law Number 7 of 1974 concerning Controlling Gambling. This study used a qualitative research method with a qualitative descriptive approach obtained from primary data and secondary data. The conclusion from the results of this study is that in the review of Islamic law, buying and selling children's toys is prohibited because of the practice of raffling which will harm one of the parties. In addition, buying and selling children's toy lottery is also against Law Number 7 of 1974 concerning Controlling Gambling because this practice is contrary to norms, morals, decency and law, and endangers the life of society, nation and state.
