Tinjauan Hukum Ekonomi Syariah dan Hukum Positif terhadap Peredaran Produk Pangan Industri Rumah Tangga tanpa Sertifikat Produksi (Studi Kasus Kripik Ketela Niki di Kudus)

Abstract


Today, both large and small scale industries have shown their existence. Due to intense competition, small-scale industries or often called home food industries are starting to show their teeth. However, in practice there are still business actors who are negligent in carrying out their obligations. One of them concerns the ownership of mandatory production certificates for food home industries. This research examines the circulation of processed food products for home industries without production certificates (Kudus Niki Potato Chips) in terms of Islamic economic law and positive law. The research method used is field research and a qualitative approach that focuses on interaction patterns and goes directly to the field. From the results of this study, it was concluded that Niki Potato Chips products are still not in accordance with the applicable positive law, because business actors do not yet have a certificate of home industry food production (SPP-IRT). Then, when viewed from sharia economic law from the perspective of maqashid al-shari'ah, it can be concluded that Sweet Potato Chips can be said to have protected the soul (hifdzu nafs). It is concluded like that, because business actors explain that their products are safe for consumption. In fact, carrying out economic activities must be based on a sense of trust, both from business actors and consumers.
